Landlord consent to sublet in NYC: what the letter must say

A sublet consent request in New York must be sent by certified mail, return receipt requested, and must state: the term of the sublease, the name of the proposed subtenant, the subtenant's business and permanent home address, the tenant's reason for subletting, the tenant's address for the term of the sublease, the written consent of any co-tenant or guarantor of the lease, and a copy of the proposed sublease with a copy of the tenant's lease attached, acknowledged by the tenant and subtenant. Send it at least 30 days before the sublet starts.

Reviewed October 28, 2026 by the SubletNY team against the sources listed at the end.

The checklist, item by item

Every item below comes from § 226-b(2)(b). A request missing one of them lets the landlord ask for it and restarts the clock, so include all of them the first time.

  • The term of the sublease (start and end dates).
  • The name of the proposed subtenant.
  • The business and permanent home address of the proposed subtenant.
  • The tenant's reason for subletting.
  • The tenant's address for the term of the sublease.
  • The written consent of any co-tenant or guarantor of the lease.
  • A copy of the proposed sublease, with a copy of the tenant's own lease attached, acknowledged by both tenant and subtenant.

The two clocks

Within ten days of mailing, the landlord may ask for additional information, limited to what is reasonably needed to decide. Within thirty days of the mailing of the request or of the additional information, whichever is later, the landlord must send consent or a refusal with reasons. No answer within thirty days is deemed consent.

If the refusal is reasonable, the tenant may not sublet and may not be released from the lease. If it is unreasonable, the tenant may proceed with the sublet in accordance with the request, and the landlord may not sue to recover possession over it.

A template you can adapt

Date. Landlord name and address. "Re: Request for consent to sublet [apartment, address], pursuant to Real Property Law § 226-b. I am the tenant of record under a lease dated [date], which ends on [date]. I request your consent to sublet the apartment from [start] to [end] to [name], whose permanent home address is [address] and whose business address is [address]. My reason for subletting is [reason]. During the sublease my address will be [address]. [Co-tenant / guarantor name] consents in writing (attached). A copy of the proposed sublease, acknowledged by both of us, is attached, with a copy of my lease. Please reply within thirty days as the statute provides. Sincerely, [name]."

Send it certified mail with return receipt, keep the receipt and a copy of everything, and diarise day ten and day thirty.

Rent-stabilized tenants: two more lines

Add that the apartment will remain your primary residence and that you intend to return at the end of the sublease, and keep the sublet within two years in any four-year period. The subtenant's rent may not exceed the legal rent plus 10 percent for a furnished sublet. Common questions

How far in advance do I send the consent letter?
At least 30 days before the sublet starts, because the landlord has thirty days to answer; allow for a ten-day request for more information on top.
What if my landlord does not reply?
Silence for thirty days after a complete request sent by certified mail is deemed consent under § 226-b, and you may proceed.
Can the landlord charge a fee for consenting?
The statute does not provide for a consent fee; a lease may set a reasonable administrative charge, and co-op boards commonly do, so check your lease or proprietary lease.

Room in Shared Apartment

Greetings, You have discovered our favorite place in all of New York. Located on one of the oldest streets in the city, facing a 100+ year old tree, this apartment is known as 'The Treehouse'. Home to an Artist and a Scholar. Thanks to our new edition of tatami mats, our shared living space has been converted to a 'Teahouse' of sorts. It also has a futon we added to be considered as a couch, however, it is also able to be put to the side for more space. A creative space to stimulate inspirational growth. I have lived in this unit the past 9 years with my roommate and we are currently looking for someone to sublet the bedroom downstairs. This was both of our first homes in the city and our only reason for staying. We are looking for someone who understands the energy of the space and who is willing to look after it with the same care as we do as well as bring their own creative force. In a city like NYC, a sacred refuge such as this treehouse becomes a nourishing oasis that never ceases to recharge and revitalize. Perfect for the fall season of new york weather. The rooftop terrace has some of the best roof views I personally have experienced. The entire apartment can be considered a duplex, with a roommate (Mohamad) who lives upstairs. He is a scholar specializing in Islamic Studies at Columbia University. The area the roof faces is a garden of the building across the street, so it is extremely quiet. You do not hear any traffic. It is also home to a variety of bird species such as Blue Jays, Red Cardinals there are also Falcons and Hawks that make their way onto the roof. To watch the tree change seasonally is a tranquil gift. Ideally this is a place for someone who wishes to seek inspiration within New York City, or someone who wishes to live like an Artist. We have spent the last few years crafting this space as an Artists residency that has housed creative friends and family from all walks of life. Ideally, we keep this artistic energy strong within the Treehouse and are looking for like minded individuals who work within the creative field This place can be more or less considered a New York City retreat, or an Artist's residency. Perfect for someone's first visit to NYC as it will set the tone for what the city truly has to offer if you are able to sit and listen. Also ideal for someone who knows the city and is looking for a unique perspective to reignite forgotten passion. This is a very special place and has evolved and come to life over the years. It is very sensitive to energies and we are looking for someone who respects this. This place is to be treated more so like a living gallery or museum. We look forward to seeing what story you will share with this space. It is a companion in and of itself and will look after you, as you look after it. There is a NO outside guest and pet policy unfortunately. Due to the nature of this space and the items within it. Exceptions may apply so please inquire. There are 2 bedrooms and 1 shared living space. PLEASE NOTE: Dining area is in the hallway where there is a foldable bar and stools. Will explain upon inquiry and upon tours. Pictures are there for reference. Please note that there will be an interview process with potential applicants. We are looking for someone to sublet from November 1st - March 1st. (For the fall and winter season) However, dates are flexible and prorated options are available however, rent adjustments may become applied. If you are looking for something month to month please let us know. Rates are subject to change based off availability. Will require Rent + Security deposit. Price does not include utilities. With internet the total ranges but averages around 100$ per person. A list of amenities: - Wifi plus smart TV - Microwave - Kitchen sink filter - Shower head filter - AC in both rooms - Full plant nursery. - Treehouse Teahouse room - Curated Tea blends - TV with internet access - Library of books - Rooftop access - Private roof deck - In building laundry drop off service - Local recommendations - and other little vibe tips and tricks that we can go over. Serious inquiries only. Thank you and have a beautiful day.
