Sublet agreement in NYC: what to put in writing

A sublet agreement should name the tenant and the subtenant, state the start and end dates, the rent and the day it is due, the deposit and the conditions and deadline for its return, what is included (furniture, utilities, internet, linens), who repairs what, that the subtenant is bound by the terms of the original lease (attached), how either side can end it early, and how keys and move-out work. One or two pages, signed by both, with a copy of the landlord's consent, is enough for most sublets.

The clauses that prevent most disputes

Each clause below answers a question that otherwise gets argued about on move-out day.

  • Parties and premises: full names, the apartment address, and which rooms are private or shared.
  • Term: start and end dates; whether it continues month-to-month after the end date and with how much notice.
  • Rent: the amount, the due date, how it is paid, and what happens if it is late.
  • Deposit: the amount (New York caps a residential security deposit at one month's rent), what it may be used for, and the deadline for returning it with an itemised statement.
  • What is included: furniture and appliances by room, utilities, internet, cleaning, linens; who pays for what is not included.
  • Condition: a move-in photo set or checklist signed by both, and the standard for return (broom-clean, same condition less ordinary wear).
  • Repairs and problems: who the subtenant calls, who pays for what, and that the tenant stays responsible to the landlord.
  • The original lease: attached, and the subtenant agrees to follow its rules (no smoking, pets, noise, guests).
  • Early termination: notice period and any fee, for both sides.
  • Keys, mail and move-out: how many keys, a forwarding address, and when the inspection happens.

The deposit rules in New York

Since the 2019 rent law changes, a residential security deposit in New York may not exceed one month's rent, the tenant has the right to a move-in inspection, and the deposit must be returned within fourteen days of the tenant vacating, with an itemised statement for any deduction. A sublease is a residential tenancy, so set the deposit and the return deadline to match.

What a subtenant should insist on

A copy of the original lease, proof that the person you are paying is the tenant of record (a utility bill or the lease with their name), the landlord's consent or at least the certified-mail receipt of the request, a written receipt for every payment, and a photo record of the apartment on day one.

What a tenant should insist on

Government ID and a reference for the subtenant, the deposit and first month before keys, a clause that the subtenant leaves on the end date (your own lease and the landlord's consent depend on it), and a rule for guests and overnight visitors. This guide is general information from public sources, not legal advice; for a dispute, speak to a tenant lawyer or a tenant association.

Common questions

Does a sublet agreement have to be notarised in New York?
No. A signed written agreement is enough; § 226-b asks that the proposed sublease be acknowledged by tenant and subtenant when it is sent to the landlord, which a signature satisfies in practice.
How much deposit can a sublet charge?
No more than one month's rent, the New York cap on residential security deposits, returned within fourteen days of moving out with an itemised statement for any deduction.
Can a sublet be month-to-month?
Yes: state that the sublease continues month to month after the end date and the notice either side must give; a rent-stabilized tenant must still keep the total within two years in four.

Room in Shared Apartment

Greetings, You have discovered our favorite place in all of New York. Located on one of the oldest streets in the city, facing a 100+ year old tree, this apartment is known as 'The Treehouse'. Home to an Artist and a Scholar. Thanks to our new edition of tatami mats, our shared living space has been converted to a 'Teahouse' of sorts. It also has a futon we added to be considered as a couch, however, it is also able to be put to the side for more space. A creative space to stimulate inspirational growth. I have lived in this unit the past 9 years with my roommate and we are currently looking for someone to sublet the bedroom downstairs. This was both of our first homes in the city and our only reason for staying. We are looking for someone who understands the energy of the space and who is willing to look after it with the same care as we do as well as bring their own creative force. In a city like NYC, a sacred refuge such as this treehouse becomes a nourishing oasis that never ceases to recharge and revitalize. Perfect for the fall season of new york weather. The rooftop terrace has some of the best roof views I personally have experienced. The entire apartment can be considered a duplex, with a roommate (Mohamad) who lives upstairs. He is a scholar specializing in Islamic Studies at Columbia University. The area the roof faces is a garden of the building across the street, so it is extremely quiet. You do not hear any traffic. It is also home to a variety of bird species such as Blue Jays, Red Cardinals there are also Falcons and Hawks that make their way onto the roof. To watch the tree change seasonally is a tranquil gift. Ideally this is a place for someone who wishes to seek inspiration within New York City, or someone who wishes to live like an Artist. We have spent the last few years crafting this space as an Artists residency that has housed creative friends and family from all walks of life. Ideally, we keep this artistic energy strong within the Treehouse and are looking for like minded individuals who work within the creative field This place can be more or less considered a New York City retreat, or an Artist's residency. Perfect for someone's first visit to NYC as it will set the tone for what the city truly has to offer if you are able to sit and listen. Also ideal for someone who knows the city and is looking for a unique perspective to reignite forgotten passion. This is a very special place and has evolved and come to life over the years. It is very sensitive to energies and we are looking for someone who respects this. This place is to be treated more so like a living gallery or museum. We look forward to seeing what story you will share with this space. It is a companion in and of itself and will look after you, as you look after it. There is a NO outside guest and pet policy unfortunately. Due to the nature of this space and the items within it. Exceptions may apply so please inquire. There are 2 bedrooms and 1 shared living space. PLEASE NOTE: Dining area is in the hallway where there is a foldable bar and stools. Will explain upon inquiry and upon tours. Pictures are there for reference. Please note that there will be an interview process with potential applicants. We are looking for someone to sublet from November 1st - March 1st. (For the fall and winter season) However, dates are flexible and prorated options are available however, rent adjustments may become applied. If you are looking for something month to month please let us know. Rates are subject to change based off availability. Will require Rent + Security deposit. Price does not include utilities. With internet the total ranges but averages around 100$ per person. A list of amenities: - Wifi plus smart TV - Microwave - Kitchen sink filter - Shower head filter - AC in both rooms - Full plant nursery. - Treehouse Teahouse room - Curated Tea blends - TV with internet access - Library of books - Rooftop access - Private roof deck - In building laundry drop off service - Local recommendations - and other little vibe tips and tricks that we can go over. Serious inquiries only. Thank you and have a beautiful day.
